1. Acceptance of Terms

By accessing or using the Perkorsi platform (the "Service"), operated by One3Four ("we", "us", or "our"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, you must not use the Service.

2. Description of Service

Perkorsi is an AI-powered travel planning application that helps users create personalised itineraries. The Service includes features such as AI itinerary generation, interactive maps and directions, destination weather information, place details and photos, and the ability to save and manage trip plans.

The Service is provided for informational and planning purposes. We do not act as a travel agency, tour operator, or booking platform.

3. Account Registration

To access certain features of the Service, you must create an account. By registering, you agree that:

• You are at least 13 years of age.
• The information you provide is accurate, current, and complete.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You will notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscription Plans and Payments

The Service offers both free and paid subscription plans. Paid plans are processed through Stripe, our third-party payment provider.

• Billing: Subscription fees are billed in advance on a recurring basis (monthly, yearly, or as specified by your chosen plan), unless you have purchased a lifetime plan.
• Auto-renewal: Recurring subscriptions automatically renew unless cancelled before the end of the current billing period.
• Cancellation: You may cancel your subscription at any time through your billing dashboard. Cancellation takes effect at the end of the current billing period.
• Price changes: We reserve the right to modify pricing with reasonable notice. Existing subscribers will be notified before any price change takes effect.
• Refunds: Payments are generally non-refundable. Exceptions may be made at our sole discretion for service issues.

5. Fair Use and Token Policy

• Responsible Usage: Users are expected to utilise Perkorsi's resources responsibly and ethically. Excessive demands on our system that negatively impact service availability for others are not permitted.
• Reasonable Limits: To prevent abuse and ensure fair access to all users, One3Four imposes reasonable limits on the number of travel plans and queries that can be made within certain time frames.
• Token Usage: Each travel plan created may consume tokens from your monthly or yearly subscription allotment. We encourage users to plan judiciously to maximise their available tokens.
• Limitations on Automated Queries: Automated querying of our platform, including the use of bots or other automated systems for data extraction, is strictly prohibited unless expressly permitted by One3Four.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights.
• Abuse, overload, or interfere with the Service or its infrastructure, including circumventing rate limits.
• Scrape, crawl, or use automated tools to extract data from the Service without our written consent.
• Impersonate any person or entity, or misrepresent your affiliation.
• Upload or transmit malicious code, viruses, or harmful content.
• Attempt to gain unauthorised access to other users' accounts or our systems.

7. AI-Generated Content Disclaimer

Itineraries and travel suggestions provided by the Service are generated using artificial intelligence and are intended for informational and planning purposes only. They do not constitute professional travel advice.

You acknowledge and agree that:

• AI-generated content may contain inaccuracies, outdated information, or errors regarding opening hours, prices, availability, or safety conditions.
• You are solely responsible for independently verifying all travel information, including visa requirements, health advisories, local regulations, and safety conditions before travelling.
• Third-party data such as maps, weather forecasts, and photos are provided by external services and are subject to change without notice.
• One3Four is not responsible for any decisions made or actions taken based on AI-generated content.

8. Intellectual Property

The Service, including its design, branding, code, and original content, is the property of One3Four and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

You retain ownership of the personal trip data and preferences you enter into the Service. AI-generated itineraries may be used by you for personal, non-commercial purposes. We reserve the right to use aggregated and anonymised usage data to improve the Service.

Destination photos displayed in the Service are sourced from Pexels and are subject to the Pexels License.

9. User Content

By submitting content to the Service (such as feedback), you grant One3Four a non-exclusive, royalty-free, worldwide licence to use, reproduce, and adapt that content for the purpose of operating and improving the Service.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you consent to the practices described in the Privacy Policy.

11. Limitation of Liability

To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.

One3Four shall not be liable for:

• Any travel disruptions, cancellations, or issues arising from reliance on information provided by the Service.
• Failures, interruptions, or errors in third-party services (including maps, weather data, payment processing, and AI providers).
• Loss of data, revenue, or profits arising from the use of or inability to use the Service.
• Any indirect, incidental, special, or consequential damages.

In any case, our total aggregate liability to you shall not exceed the amount you have paid to One3Four in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless One3Four, its officers, employees, and partners from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these terms, or your infringement of any third-party rights.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at our discretion if we reasonably believe you have violated these terms.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.

14. Third-Party Services

The Service integrates with and relies upon third-party services, including Google Maps Platform, Stripe, Pexels, and Open-Meteo, among others. Your use of these services is subject to their respective terms and privacy policies. One3Four is not responsible for the availability, accuracy, or practices of any third-party service.

15. Changes to These Terms

We may update these Terms & Conditions from time to time. When we make changes, we will update the "Last updated" date at the top of this page. For material changes, we will notify you by email or through a prominent notice on the Service.

Your continued use of the Service after changes are posted constitutes acceptance of the revised terms.

16. Governing Law and Disputes

These terms shall be governed by and construed in accordance with applicable law. Any disputes arising from or relating to these terms or the Service shall be resolved amicably where possible. If a resolution cannot be reached, disputes shall be submitted to the courts of competent jurisdiction.
